Terms and Conditions

By logging into Willuwalk mobile application with your Google, Facebook or Apple account, you confirm that you have read the terms of this user agreement (hereinafter: terms), agree to the terms and undertake to comply with them. The terms and conditions apply to all legal relationships between the persons who have registered as users of the mobile application and Wanlig OÜ, the manager of the application.

I Terms

1.1. Willuwalk service provider – Wanlig OÜ (reg. code: 16538121), address Vana-Lõuna 39, Tallinn 10134, contact: hello@willuwalk.app

1.2. Mobile application – Willuwalk, that belongs to Wanlig OÜ.

1.3. Services – services offered by the mobile application, including enabling users to meet, collecting points in competitions (only in Estonia), facilitating offers from partners, viewing and adding locations on the map, using AI-based smart assistant.

1.4. Conditions – the conditions on the basis of which Wanlig OÜ provides services to users.

1.5. Users – persons who have created an account in the application

II Conditions

2.1. Wanlig OÜ provides users with a mobile application for free use, through which users can send invitations to other active users for walks, participate in point collection competitions (only in Estonia), view and update locations on the map, browse user profiles and communicate with them, and use an AI-based smart assistant chat window. Some of the mentioned features above are limited in their free usage for the user. Through the use of location data, the kilometers walked by the user are tracked.

2.2. When a user logs in via Google, Facebook or Apple ID, user gives the mobile application access to certain data. Further information on what data Willuwalk collects and uses can be found in our privacy policy.

2.3. The user is responsible for the confidentiality of the login data, and the user is solely responsible for all activities that are performed using this data.

III Prizes and campaigns (only in Estonia)

3.1. Information about the prizes is presented in the leaderboard view in the mobile application.

3.2. The period during which the collected points are taken into account for the prize draw is indicated in the Info section of the leaderboard view in the mobile application.

3.3. The prize will be drawn among the hundred (100) users who have accumulated the most points.

3.4. After the period ends and the prize is drawn, the mobile application starts counting points from zero.

3.5. Wanlig OÜ reserves the right to change all points stated in Part III.

IV Marking Locations on the Map, Writing Reviews, and Adding Pictures

4.1. Wanlig OÜ reserves the right to delete, modify and moderate all added reviews, locations, and pictures.

4.2. The added information in the form of text and pictures belongs to Wanlig OÜ.

4.3. Wanlig OÜ does not take responsibility for the accuracy of the provided information.

4.4. By uploading photos, the user confirms that they own the copyright to these photos.

V Premium account: payment, prices, right of withdrawal

5.1. In order to be able to access features behind a paywall in Willuwalk, you need to create an account—if you have not already done so—make a payment and accept these Terms. You need to have an account in order to gain access to the content should you change your device and for technical reasons.

5.2. Initially, the majority of features are freely accessible to all account holders. However, specific features are governed by a complimentary usage limit, which can be accessed once. For example, the AI-based smart assistant allows for a total of 5 messages to be sent at no cost. Wanlig OÜ reserves the right to modify these complimentary quotas for any features within the Willuwalk app at its discretion. Additionally, certain features may only become accessible after a subscription payment has been made. Wanlig OÜ reserves the right to determine whether a feature includes a complimentary usage limit or requires subscription payment at its discretion.

5.3. We have a binding contract with you when you have made your payment in Willuwalk. Payment will be made from your iTunes account or your Google Play account. When you make a purchase of our services you need to be aware that it also entails an obligation to pay. Subscription options are exclusively recurring, offering monthly, quarterly, or annual billing cycles, with automatic renewal unless cancelled at least 24 hours before the subscription period concludes. Wanlig OÜ reserves the right to alter available subscription durations at its discretion.

5.4. The price presented in connection with your purchase includes VAT, where applicable based on the laws of the country in which the purchase is made.

5.5. Your purchase refers to a service with digital content where delivery begins after the purchase has been completed. There is therefore no right of withdrawal. When you have a recurring payment option, you can manage and end your subscription in the user settings for your iTunes account, which you will find in your device’s settings under subscriptions (if you have an iOS device) or in your Google Play account (if you have an Android device).

5.7. Changing the country in the app does not change the currency used for paying for the premium version. The cost of the premium version and the included VAT depend on the country where the iTunes or Google Play user is registered.

VI User rights and obligations

6.1. The user has the right to:

6.1.1. create an account if the person has never been convicted of a crime, including a sex crime or a crime of violence;

6.1.2. perform all actions enabled by Willuwalk in the mobile application at your own risk in accordance with the law, good practices and conditions;

6.1.3. close the account within thirty days from the notification of the changes at the latest, if not agreed with the changes to the terms and conditions. If the user does not close his account within this period, he is considered to have accepted the changes to the terms.

6.2. The user undertakes:

6.2.1. not to use the mobile application for illegal act(s) or fraud(s).;

6.2.2. provide completely true information when using the mobile application;

6.2.3. not allow third parties to use his account;

6.2.4. use the mobile application for its intended purpose;

6.2.5. in any communication with other users, be careful not to give out your financial information (such as credit card or bank account details) or send money to other users by bank transfer or in any other way;

6.2.6. be solely responsible for your interactions with other users. Willuwalk does not conduct criminal background or other background checks on its users. Willuwalk makes no guarantees about the conduct or suitability of members.

VII Rights and obligations of Wanlig OÜ

7.1. Wanlig OÜ has the right to close the accounts of users who have behaved inappropriately.

7.2. For security reasons, we expect users to join the app under their real name. In case of suspicious names, the platform manager reserves the right to terminate such accounts.

7.3. Wanlig OÜ may make changes to these Terms and Conditions. We may do this for various reasons, including due to changes in the law, new features or changed business practices. The most current version of these Terms will be posted on the Settings page in the mobile app. We recommend that you regularly familiarize yourself with the latest version.

7.4. Willuwalk strives to provide a respectful communication experience to its members through features such as two-way consent, which allows users to communicate and meet only after they have sent or accepted an invitation or both swiped each others profiles right. Wanlig OÜ is not responsible for the conduct of any user while using or outside of the Service.

7.5. Wanlig OÜ is not responsible for the products and/or services offered through our partner organizations listed in the “We recommends” section.

7.6. Wanlig OÜ is not responsible for the responses provided by the AI-based smart assistant. This function is managed by a third party.

7.7. The information provided in Willuwalk (articles, blog posts, partner services, products, etc.) does not constitute medical advice. Wanlig OÜ does not assume medical responsibility for the use of Willuwalk and its advice. Willuwalk serves as an information intermediary.

7.8. Wanlig OÜ does not guarantee that Willuwalk is provided uninterrupted or free from errors, viruses, or other harmful components.

7.9. Willuwalk does not provide any guarantees, either directly or indirectly. For example, but not limited to, Wanlig OÜ does not guarantee that Willuwalk is suitable for your needs or that the information in Willuwalk (articles, blog posts, partner services, products, etc.) is accurate, reliable, complete, or correct. In other words, the use of Willuwalk is at your own risk. Wanlig OÜ disclaims all direct or indirect, statutory, or other warranties, including, but not limited to, the suitability of Willuwalk.

7.10. Wanlig OÜ also reserves the right to modify, terminate, and/or suspend features in Willuwalk, including, but not limited to, functionality, features, and services, without prior notice. These terms apply to all new functionalities, features, and/or services implemented in Willuwalk.

7.11. Under no circumstances will Wanlig OÜ, its officers, directors, employees, affiliates, representatives, attorneys, or agents be responsible for the decisions or actions of you or anyone else based on the information presented in Willuwalk.

7.12. Wanlig OÜ is not liable for any direct or indirect economic or moral damages arising from the use of Willuwalk.

7.13. If you do not agree with these limitations on Wanlig OÜ’s liability, we kindly ask you not to use Willuwalk. Willuwalk would not be available to you without these limitations.
